READ THIS BEFORE YOU BID

Registering to bid and placing a bid creates a binding contract. Once you bid, you are legally bound by these terms. Bids cannot be withdrawn.

Terms can vary by sale. Each auction listing may add to or change these terms for that specific sale. Read the listing.

You must be 18 or older to bid.

Bring your own help. You are responsible for loading and removing everything you buy. Our staff show you where your items are and lend a hand where they can — they are not your loading crew. Skid steer or forklift loading is only available when the auction listing says so. Plan for this before you bid on anything large.

At onsite auctions, pickup is your only chance. When pickup ends we hand the keys back and lose all access. Anything left behind is thrown away or stays with the property — we cannot go back for it, and there is no refund.


BUYER’S PREMIUM

A 12% buyer’s premium is added to the winning bid on every purchase.

Buyers who pay in person with cash, check, or money order receive a 2% discount, for a 10% buyer’s premium. This discount is available to every buyer on every lot.


PAYMENT AND PICKUP

Your invoice is emailed within 12 hours of the auction closing, and usually within an hour. If you do not receive it, check your account dashboard under PROFILE → INVOICES.

Each auction has its own pickup day, time window, and location, and pickup is scheduled by appointment through Shipping Saint. We set a limited number of appointments per hour so we can get everyone loaded out. Pickup is not always the day after the sale closes, and hours vary by sale and location — check your auction. Pickup at our building in Canon City is generally 10:00 am to 4:30 pm.

If you can’t make your pickup time, email [email protected] before your scheduled window with your name, the auction you bought in, and what’s going on. We work with people who tell us in advance. Storage fees and suspension are for buyers who simply don’t show up and don’t call.

You have until the close of pickup on your scheduled pickup day — 4:30 pm unless your auction says otherwise — to pay in person with cash, check, or money order and receive the 10% buyer’s premium.

At the close of pickup day, any invoice not already paid is charged automatically to the card on file at the 12% buyer’s premium, plus sales tax and any applicable fees.

Items are released only after payment has posted. You are responsible for keeping a current, valid card on your account.

Invoices over $1,500. Our system caps online self-payment at $1,500. If your invoice is higher than that, you must contact us to arrange payment — cash, wire transfer, or other arrangements. Titled vehicles must also be settled by cash, wire transfer, or prior arrangement.

This cap is on what you can pay yourself online. It does not limit our right to collect: if your invoice is unpaid after the pickup deadline, we may charge the card on file for the full balance, regardless of amount.

Declined cards and returned checks. A card declined for any reason is subject to a $30 reprocessing fee. A check returned unpaid for any reason is subject to a $20 returned check charge, the maximum permitted under Colorado law, and to all remedies under C.R.S. § 13-21-109, including treble damages if the amount is not paid within fifteen days of written notice. You remain responsible for the full balance in either case.

Disputes and chargebacks. If you believe there is an error on your invoice, contact us at 719-275-1439 or the email address on your invoice before disputing the charge with your bank. Filing a chargeback without contacting us first is a breach of these terms. You will lose bidding privileges on all Woolsey Auction Company platforms and you remain responsible for the disputed amount plus any fees and costs we incur in responding, including attorney fees.


REMOVAL, STORAGE, AND ABANDONED ITEMS

All sales are final. When the auctioneer confirms your bid, the item is yours — ownership and risk pass to you at that moment. You owe the full invoice whether or not you collect the item, and we do not refund items left behind. An auction sells each lot once, to one bidder, at one price, and the consignor is paid on that result. We cannot un-sell it.

Talk to us and we’ll work with you. Email [email protected] before your scheduled pickup window with your name, the auction, and the situation. What follows is for buyers who don’t show up and never make contact.

What happens to items you leave behind depends entirely on where the auction was held. Read the part that applies to your sale.

Auctions at our Canon City building

Storage is limited and it is not guaranteed. We are a working auction house. The moment a lot leaves the floor that space goes to the next sale, so we are rarely sitting on room to spare. We can usually hold smaller items for a few days, at a cost. Large items we often cannot hold at all, and we may require that they be removed by the end of pickup day.


Storage accrues at $10 per lot, per day, beginning the morning after pickup closes, charged to the card on file.
You may collect your items at any time before they are deemed abandoned by paying the accrued storage in full.
At the close of business on the third day after pickup day, any lot still here is deemed abandoned. We will notify you at the email address and phone number on your account.
Once abandoned, Woolsey Auction Company may resell or dispose of the lot at its discretion. Proceeds are applied to storage, handling, and disposal costs.


Onsite auctions at any other location

Pickup is your only opportunity. There is no storage period.

When the scheduled pickup ends, we load out, lock up, and hand the keys back to the property owner. After that we have no access to the property and no way to retrieve anything. Many of these properties transfer to a new owner within a day of the sale.

If you do not remove your items during the scheduled pickup window at an onsite auction, one of two things happens, and neither one ends with you getting your items:


They are thrown away. Our contract with the seller often requires us to leave the property empty and broom-swept, which is standard when a real estate closing follows the sale. When that applies, anything still there when we finish is discarded. We do not have the option of setting it aside for you.
They stay with the property. Where we are not required to clear the property, items left behind become the property owner’s to deal with, and what happens to them is out of our hands.


In either case:


We cannot retrieve, store, hold, or return your items. This is not a matter of policy — we are no longer allowed on the property.
You are not entitled to a refund.
Woolsey Auction Company is not responsible for items left at a location we no longer control, or for what becomes of them.


If you need us to haul items back for you, arrange it before pickup day by emailing [email protected]. Hauling is available by prior arrangement only, is quoted in advance, is charged to you, and we may decline it.

Disposal costs

Disposal of anything left behind may be charged to the card on file at actual disposal cost plus $50 per hour of staff time, with a one-hour minimum. Hauling a couch, mattress, or appliance to the transfer station takes a truck, a driver, and a tipping fee, and that is what this covers.

Hazardous or regulated items — tires, batteries, paint, fuel, appliances containing refrigerant — are charged the same way.

Repeated failure to remove items results in loss of bidding privileges on all Woolsey Auction Company platforms.


LOADING AND REMOVAL

Plan your loadout before you bid. By bidding, you agree to bring enough people, and the right vehicle, trailer, straps, and tools, to load and remove everything you buy.

What our staff do on pickup day. We show you where your lots are, confirm you are taking the correct items, and lend a hand where it is reasonable and safe to do so. We are glad to help. What we are not is your loading crew — our staff will not be the labor that moves a 3,500-pound safe, a pallet of tooling, or a truckload of furniture into your vehicle.

Machinery is never guaranteed. Some auctions include loading by skid steer or forklift for large equipment and implements. When we offer that, it is stated in the auction listing. Do not assume machinery will be available. We frequently do not have equipment on location at onsite auctions, and the fact that a machine was there for one sale tells you nothing about the next one. If you will need machinery to load, confirm it is available before you bid — email [email protected].

If you arrive without adequate help or equipment. You may not be able to remove your items that day, and storage charges begin as scheduled. If our staff are available and willing to do the loading for you, it may be billed at $50 per hour with a one-hour minimum.

Safety. Our staff may decline to lift, move, or load anything they judge unsafe, and may decline to load a vehicle or trailer they judge unsuitable for the load. That decision is final and is not grounds for a refund, an adjustment, or a waiver of storage.

Risk. Woolsey Auction Company is not responsible for loading your purchases, for damage to your items or your vehicle during loading, for injury during loading, or for securing your load for safe travel. Anyone loading or removing items does so at their own risk.

Discretion. Any help we give is a courtesy, based on who is on hand and how busy we are that day. Helping another buyer, or helping you once, does not entitle you or anyone else to help in the future.

Woolsey Auction Company may reduce or waive any fee at our discretion. Choosing not to charge a fee in one instance does not waive our right to charge it in another, and does not change these terms.


HOW OUR ONLINE AUCTIONS WORK

Staggered ending. Lots close at a set rate rather than all at once, so you can bid on multiple items in the same sale. Watch the countdown timer on each lot.

Soft close. A bid in the final minutes extends that lot by one minute, giving other bidders a chance to respond.

Max bid. Enter your highest price and the system bids on your behalf up to that amount. We recommend it — you don’t have to watch the clock.

Force bid. Raises the current bid directly to the amount you enter.

Outbid notices. If you are outbid you’ll be notified by email, and by text message if you have turned on text notifications in your account settings. Notices are a courtesy, not a guarantee — delivery can fail for reasons outside our control, and it is your responsibility to monitor your bids.

Bids are binding. Bids cannot be retracted or withdrawn. If you enter an obvious keystroke error on a max bid, Woolsey Auction Company may reduce it to the current high bid at our sole discretion. This is a courtesy, not a right, and you remain the high bidder.

Timing. All posted times are local to the auction site and are approximate. We may close early, extend, reset, or reopen any auction or lot at our sole discretion.

Technical problems. Hardware failures, software failures, viruses, and connection problems happen. If our site malfunctions, we may reopen the auction and set a later closing time. We are not responsible for problems with your internet connection, your device, or your email, and you agree to hold Woolsey Auction Company harmless for any resulting damages or costs.


CONDITION AND WARRANTIES

Everything is sold AS IS, WHERE IS, with no warranties or guarantees of any kind, express or implied. All sales are final.

Descriptions and photos are provided in good faith but we do not guarantee accuracy, authenticity, or condition, and we are not responsible for errors in cataloging or defects not noted. No adjustment, refund, or cancellation will be made for any incorrectness or imperfection.

All items are available for preview. You are responsible for inspecting anything you intend to bid on and forming your own opinion of its condition.


SALES TAX

Sales tax is charged on every purchase as required by state and local law. The rate is set by where the auction is physically held, not by where you live. Auctions at our building in Canon City are taxed at 8.7%. Onsite auctions are taxed at the rate for that location.

Tax exempt buyers must send a completed Colorado Form DR 5002, Declaration of Wholesale or Entity Sales Tax Exemption, to [email protected]. The form is at https://tax.colorado.gov/DR5002. This includes coin purchases. If you enter a tax number and we do not have the form on file, sales tax is due before pickup.


SHIPPING

Shipping is available on small items. We are not a shipping company and we do not ship for free.

All shipping is handled through Shipping Saint. You will receive a separate shipping invoice showing packaging, materials, and freight.

Packaging and materials are billed at our cost, including what it costs us to get boxes and tape in the door. The amount depends on the size of the box, so it varies by item. Actual shipping and insurance are charged to the card on file, insured for the invoiced amount unless you tell us otherwise.

We combine lots into one box where we can to keep your cost down, unless you tell us not to. Oversized or fragile items may be sent through the local UPS store.

BIDDER REGISTRATION AND YOUR ACCOUNT

You must be 18 or older and provide current, complete, and accurate information.

You are responsible for the security of your username, password, and bidder number, and for every bid placed under your account. Tell us immediately if you believe your account has been compromised.

Registration is not transferable. We may refuse, suspend, or terminate any registration, reject any bid, and deny access to any person at our sole discretion.

Consignors, sellers, and their agents may not bid on their own consigned goods. Woolsey Auction Company employees may bid, on the same terms as any other bidder and with no advantage, information, or preference.


COMMUNICATIONS

Auction and transaction messages. By registering to bid, you agree that Woolsey Auction Company may contact you by phone and email about your account, your bids, and your purchases — including registration, bid and outbid notices, auction closings, invoices, payment, and pickup. You agree we may send these at any time, without limitation as to the day of the week or the time of day. These are part of doing business with us and are not marketing.

Email marketing. By registering to bid, you consent to receive marketing emails from Woolsey Auction Company, including auction announcements, sale bills, and upcoming sale reminders. Unsubscribe any time using the link in any marketing email or by emailing us. Unsubscribing does not stop the transaction messages above and does not affect your ability to bid.

Text notifications are optional and off by default. You can turn on text alerts for your bids — outbid notices and similar — in your account settings, or by asking us to turn them on for you. These are about your own bidding activity. You can turn them off the same way at any time.

We do not sell or rent your information.


REQUIRED DOCUMENTS

Buyers and sellers must complete all required paperwork in full — death certificates, letters of authority, creditor liens, and UCC filings where applicable. Titled vehicles require completed title paperwork before release.


FIREARMS

Woolsey Auction Company holds a Federal Firearms License and a Colorado Department of Revenue firearms dealer license. We run background checks in house.

Colorado law requires a three-day waiting period before any firearm can be delivered. We cannot hand you a firearm on pickup day, even if your background check clears right away. This is not our policy — releasing a firearm early is a civil violation under Colorado law.

What you must do on pickup day: come in and start the process. Complete your ATF Form 4473 and let us initiate the background check. That is your pickup-day obligation for firearms — starting the process, not leaving with the gun.

Once the waiting period has run and your background check is approved, we will contact you to arrange release. Storage does not accrue on a firearm while we are waiting out the mandatory period. If you do not collect within seven days after we notify you it is ready, normal storage charges begin.

If you do not come in on pickup day to start the process, the normal storage and abandonment terms apply.

Firearms won at onsite auctions are transported back to our Canon City location. They are never left at the sale site.

Out of state buyers must have firearms shipped to a licensed FFL dealer in their own state, at their expense.

Antique and curio or relic firearms may be exempt from some of these requirements. We will tell you whether a lot qualifies.

Colorado firearms and ammunition excise tax

Colorado charges a 6.5% excise tax on firearms, firearm precursor parts, and ammunition. It is added to your invoice on those lots, separately from sales tax.

Peace officers, active duty members of the U.S. Armed Forces, and law enforcement agencies are exempt. Send a completed Colorado Form DR 7612 to [email protected] before pickup day. Without the form on file, the tax is charged.

Specified semiautomatic firearms — eligibility card required

As of August 1, 2026, Colorado law (Senate Bill 25-003) requires anyone purchasing a Specified Semiautomatic Firearm to hold a valid Firearms Safety Course Eligibility Card issued by their county sheriff, along with current qualifying training. We are required to verify this electronically before we can transfer the firearm, and we cannot make an exception for anyone. A dealer who transfers without verifying commits a misdemeanor on a first offense and a felony after that, and loses their state dealer permit.

By bidding on any lot identified as a Specified Semiautomatic Firearm, you represent that you currently hold a valid Colorado eligibility card and completed training, and that you are legally able to take delivery. If you do not hold a card, do not bid on these lots.

Woolsey Auction Company may require proof of a valid eligibility card before approving any bidder for a firearms auction, and may refuse or revoke bidding privileges for any person at our discretion.

If you cannot take delivery of a firearm

If you are denied on a background check, cannot produce a valid eligibility card, or are otherwise unable to lawfully receive a firearm you have won, we cannot transfer it to you. Colorado law does not give us a choice.

Appeals — we will hold the firearm, but you have to talk to us.

A denial can sometimes be appealed through the Colorado Bureau of Investigation. We will hold your firearm while a properly initiated appeal is pending. To get that hold, you must:


Notify us in writing within 5 business days of the denial that you are appealing, and
Keep us informed of the status until it is resolved.


Storage accrues during this period. If your appeal succeeds and we still have the firearm, we will complete the sale.

We will resell the firearm if you tell us you are not appealing, your appeal is denied, you do not notify us within 5 business days, or you stop communicating with us for 30 days.

When we resell, at our option Woolsey Auction Company will either:

(a) retain the greater of $250 or 20% of your winning bid as liquidated damages and refund the balance to you; or

(b) charge you a $250 minimum resale fee, the shortfall if the firearm resells for less than your winning bid, the buyer’s premium lost on your purchase, and accrued storage — refunding anything you paid above those amounts.

We choose which of these applies. Firearms carry paperwork, transfer records, tracking obligations, and re-cataloging that ordinary lots do not, and that is what the resale fee covers. As for the shortfall: an auction establishes value at one moment, in front of one group of bidders. The same firearm offered again by the same company rarely brings the same price, and that shortfall is a direct result of a bid that should not have been placed.


RESERVES AND AUCTIONEER DISCRETION

All lots are sold subject to a reserve unless the auction is advertised as absolute.

Woolsey Auction Company may terminate an auction at any time, withdraw any item from sale, sell items not listed, group or subdivide lots, and sell all items in bulk.


PHOTOS AND DESCRIPTIONS

All photos and descriptions on woolseyauction.com are the property of Woolsey Auction Company. Use of our photos or descriptions on any other site is prohibited without written permission.


DEFAULT AND COLLECTION

If you fail to pay in full by the deadline above, you are in default. Woolsey Auction Company may charge the card on file for the full balance, cancel the sale of any unpaid lot and resell it, apply any partial payment against what you owe, revoke your bidding privileges, and pursue collection of the remaining balance.

If a resold lot brings less than your winning bid, you remain responsible for the difference plus the cost of reselling it.

Unpaid accounts are also responsible for storage, trucking, deficiency balances, collection costs, and legal fees. Unpaid invoices must be resolved within 24 hours of the charge failing. After that, bidding privileges are revoked permanently.

Privileges may be restored one time by paying what is owed and keeping a valid card on permanent file. Repeated nonpayment or failure to remove items results in a permanent ban.


LIABILITY

Woolsey Auction Company assumes no liability for your purchases. You agree to indemnify and hold Woolsey Auction Company and the seller harmless from any claim relating to the fitness or use of anything you buy.

Anyone attending a preview, sale, or removal does so at their own risk and assumes all risk of damage or loss to person and property. Neither Woolsey Auction Company nor the seller is liable for any defect in or condition of the premises where a sale is held.

We are not responsible for lost or stolen items once your bid is confirmed.


DISPUTES

Governing law. These terms are governed by the laws of the State of Colorado.

Venue. Exclusive venue for any dispute is the state courts located in Fremont County, Colorado.

No class actions. Any claim must be brought individually. You and Woolsey Auction Company each waive any right to bring, join, or participate in a class, collective, consolidated, or representative action.

Jury waiver. To the extent permitted by law, you and Woolsey Auction Company each waive the right to trial by jury.

Attorney fees. If either party takes action to enforce these terms or collect an unpaid balance, the prevailing party is entitled to recover its reasonable attorney fees, court costs, and collection costs.


GENERAL

Auction-specific terms control. Each auction listing may add to or change these terms for that sale. Where they conflict, the auction listing wins.

Discretion and non-waiver. We may reduce, waive, or decline to enforce any provision of these terms in any individual case. Doing so once does not waive our right to enforce it in any other case and does not modify these terms.

Severability. If any provision of these terms is found unenforceable, the rest stays in effect and the unenforceable provision is limited only as far as necessary.

Changes. We may update these terms. The version posted with an auction at the time you bid is the version that governs that purchase.
