Easement & Road Maintenance Provisions

• Existing 45’ Easement (Access from Alton Road):
A road maintenance agreement shall be recorded, with cost and responsibility shared equally among the winning Bidders. If a single Purchaser acquires the entire parcel, the road maintenance agreement will not be recorded, and that Purchaser shall bear full responsibility for maintenance of the easement.

 

• Proposed 30’ Easement (Access to Lots 3 & 4):
If Lots 3 and 4 are sold separately from Lot 2, the cost of creating and maintaining the access shall be shared between the Purchasers of Lots 3 and 4. However, if the Purchaser of Lot 3 also acquires Lot 2, then Lot 3 will have access without use of the 30’ easement. In that case, the full cost and responsibility of creating and maintaining the access shall be borne by the Purchaser of Lot 4.
