Going on the auction block, selling by online bidding only, will be the following real estate selling in one parcel. 117 acres with approximately 103 acres of open land and the balance being wooded. The wooded area has marketable timber. Improvements and amenities include an approximately 1,200 square foot concrete block house in need of repairs, a 24 ft. x 40 ft. metal sided shop building, three large ponds, paved road frontage on Hwy 144, county water availability and a dilapidated barn. The deed descriptions total 117.18 acres. This farm is being sold by the boundary and not by a per acre basis. If the buyer has the farm surveyed and the total acreage is different than advertised, the selling price will not change. This is a court ordered Master Commissioner auction. TERMS & CONDITIONS: REAL ESTATE: a.) That the terms of the sale shall be either cash or ten percent (10%) of the purchase price in the form of a cash deposit at the time of the sale and balance of the purchase price on a credit of 30 days. If the purchaser elects to take credit for the balance, then the purchaser will be required to post bond and furnish acceptable surety thereon. Said bond shall be for the unpaid balance of the purchase price and bear interest at the rate of 6 percent (6.00%) per annum from the date of sale until paid. The Master Commissioner will retain a lien upon the subject real property sold to secure the payment of the sale price. b.) All delinquent taxes will be paid from the proceeds of the sale. The 2025 taxes will be prorated to the date of closing. The property shall be sold “as is” and possession shall pass to the purchaser(s) upon delivery of deed. Risk of loss shall pass to the purchaser(s) upon execution of bond of sale or payment of the purchase price in full whichever occurs first; and c.) The real property shall be sold free and clear of any right, title or interest of all parties to the action and all liens and encumbrances thereon of any party.
